As of April 1st, the Texas bar exam is still scheduled to go forward in July 2020. Texas has not provided any sense of whether they will postpone the exam, cancel the exam, or look at alternatives to licensure. The Texas BLE, in collaboration with the Texas Supreme Court, is evaluating the best path forward. The decisions of other states will certainly influence what Texas ultimately decides to do.

Of course, the National Conference of Bar Examiner’s (NCBE) recent announcement to make a decision about a July exam on or about May 5th will impact what any state that licenses the MBE or MPT from them will be able to do in administering the bar exam. Even if Texas decided to go forward with the July bar, we would be unable to unless the NCBE also plans to make materials for a July exam. The NCBE has indicated they will make the July bar materials available if enough states still plan to go forward with the July bar that there could be proper equating of scores as required by the equipercentile method of scoring.

For the time being, we are waiting for a Texas decision and watching what other states decide. Particularly those states that are further along in their experience with COVID-19.
